These Terms and Conditions apply to all orders placed on www.vytria.com (hereinafter the "Website") and by placing an order on the Website you agree to them. Please read this information carefully before placing any order and if you have any questions please contact us using the information on the Contact Us page. Diagonal Eyewear SL (www.vytria.com) reserves the right to modify these Terms and Conditions if necessary and without notifying the user/customer. Each order will be subject to the terms and conditions established at the time it is place.
We remind you that to ensure the best experience on our website you may not copy, reproduce, redistribute, transmit, publish, create derivative works or otherwise use the website in whole or in part the content or any software used therein, except with written permission from Diagonal Eyewear SL. We reserve the right to prohibit access to the site and terminate the account of any user who violates these Terms and Conditions.
CHANGES ON TERMS & CONDITIONS
Diagonal Eyewear S.L. reserves the right to modify these Terms and Conditions at any time and such modifications shall be effective immediately upon posting on the website. Thus, your continued use of the website following the posting of changes to these Terms and Conditions will mean that you accept such changes as it is your responsibility to check our website periodically.
PRICES & PRODUCTS
The prices of our products are shown in euros, American dollars or pounds depending on the country from which you visit us and may change without notice due to changes in exchange rates, sales or other commercial factors.
The cost of each shipping method is indicated in our Shipping Policy.
Diagonal Eyewear tries to ensure that all information provided on our website is accurate, although errors may occur. If we discover an error in any price we will inform you as soon as possible in order to offer you a solution.
Diagonal Eyewear S.L. will not be liable to you or any third party for any modification, price change, suspension or interruption of service.
ORDERS
Only one order can be placed through our website: www.vytria.com. Once the order is placed you will automatically receive an e-mail confirmation.
Diagonal Eyewear S.L. reserves the right to suspend the service or cancel an order in the following cases: incidence with the payment, attempted fraud, product availability, or existence of obvious technical errors in the prices, promotions or conditions of sale shown on the web, including combinations of discounts not allowed or system failures that alter the final price.
If we are unable to process your order for any of these reasons, we will inform you as soon as possible to offer you the best solution.
LOG & ACCOUNT
You may be required to log and create a customer account to use certain features on our website. By registering on our website you are agreeing to provide complete and accurate registration information including your email address and payment information so that we can properly complete your transactions and/or contact you if necessary. You are also agreeing to keep such information up to date in order to receive the best service from us.
By creating this account you become solely responsible for maintaining the security of your account and password and agree to notify Diagonal Eyewear S.L. of any unauthorized use of your account and password.
The submission of your personal information is governed by our Privacy Policy.
Diagonal Eyewear S.L. reserves the right to delete any customer account that breaches any of these Terms and Conditions, provides false information or accounts that have been inactive for at least one year.
PAYMENTS
For an order to be properly registered on the website, the customer must make the payment by choosing one of our available payment methods: card, PayPal, Klarna, Amazon Pay.
The customer is solely responsible for ensuring that he/she has the necessary permissions to use the payment method he/she has chosen. Diagonal Eyewear S.L. has no access to the user's payment methods.
SHIPPING
The order will be sent to the delivery address that you have indicated during the purchase process, so we ask that before confirming the order please review this information to verify that it is correct as you are solely responsible for it. If once the order is confirmed you discover that there is any error in the delivery information, please contact us and we will try to help you as soon as possible.
Also, once the package has been delivered to the carrier, the responsibility for the shipment and receipt of the goods rests with the buyer. In the event that the goods are delivered to a person other than the holder of the purchase or if the delivery is made to an incorrect address, the company will not assume any responsibility for loss, theft or damage to the product.
The estimated delivery times are as indicated in our Shipping Policy. We will do our best to ensure that your order arrives on that date, but there may be circumstances that delay delivery. If this happens, we will try to expedite the process as much as possible, but we are not responsible for any external problems caused by this delay.
As a general rule, our courier services will make a delivery attempt and if you are absent you will be offered an alternative to deliver or collect the order.
RETURNS
You may return any product purchased on the website within 14 days of receipt of the order. To return a product you must follow the instructions provided in our Returns Policy.
You have the right to withdraw from this contract within 14 calendar days without giving any reason. Those 14 days are counted from the date you or a third party designated by you collect the order.
In the event that a package is lost during the return process, responsibility lies entirely with the shipping company, as it is the party in custody of the package at that time. Refunds or compensation will depend exclusively on the coverage offered by that company in accordance with its own policies and insurance.
RETURNS FOR RAY-BAN META, OAKLEY META AND EVEN REALITIES
Ray-Ban Meta, Oakley Meta, and Even Realities products stand out for their innovative nature and for offering an experience unlike any other glasses on the market. Their unique features make them exclusive items, something that the brands themselves have sought to reflect through their packaging.
Each Ray-Ban Meta is delivered properly packaged and sealed, to ensure its integrity in transit and avoid any kind of manipulation.
In order to guarantee this exclusivity and given the technological characteristics of the product, once unpacked, the Ray-Ban Meta sunglasses cannot be returned, since their shipment in inadequate or unsealed packaging may damage the article.
RIGHT OF WITHDRAWAL
In accordance with the provisions of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users, we inform you that you may exercise the right of withdrawal from the contract of sale.
You can make use of this right within 14 calendar days from the day you receive the order at home, and without any justification.
In order to exercise this right you must expressly communicate your decision to withdraw by sending a written notice to this address: Rúa Papa Juan XXIII, 5, 32003 Ourense. In this notification you must clearly indicate the following information:
· The cancellation of what order/product you are placing.
· Where you ordered and received the order/product.
· Your name and address
· Signature and date
If you choose to cancel within 14 days we will refund you as soon as possible to the same method of payment. However, you will have to bear the cost of returning the order/product. We also inform you that you as consumer and user will be responsible for the diminution of the value of the goods resulting from a manipulation other than that necessary to establish the nature, characteristics or functioning of the products purchased. Diagonal Eyewear S.L. will not make any refund if the product received is not in the same conditions in which it was delivered.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law Diagonal Eyewear S.L. shall not be liable for any indirect, incidental, special, consequential or punitive damages, including, without limitation, damages for loss of profits, use, data or goodwill arising out of the use or inability to use our website, even if Diagonal Eyewear S.L. has been advised of the possibility of such damages.
Diagonal Eyewear S.L.'s total liability with respect to the website or the products contained therein shall be limited to the amount paid for them.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law.
PRIVACY POLICY
The use of your personal information will be carried out in compliance with the conditions contained in our Privacy Policy. We recommend that you read it as by using the website you will be consenting the use of your data, as described in the Privacy Policy, and you warrant that all information you provide is real.
APPLICABLE LAW & JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Spain. You agree to the exclusive jurisdiction of the courts of this state in connection with any dispute arising out of these Terms and Conditions.
PROMOTIONS & OFFERS
Diagonal Eyewear S.L. may grant its customers special promotions or occasional discounts in the form of discount codes or any other format that is more convenient action. Unless otherwise stated, promotions via discount code will not be applied to products that already have a discount applied.
These promotions will be communicated via email and/or our website.
The conditions of application to our special promotions will appear in its format indicating:
· General and special application conditions.
· Expiration date.
· Excluded products and/or brands, if applicable.
How to take advance of a discount coupon?
Select and add to the shopping cart all the items you wish to purchase.
Proceed to the checkout process.
Enter the code in the "Add discount coupon" section and click "Validate".
Check in the order summary that the discount code has been applied correctly.
If the discount code has not been redeemed correctly, it may be due to several reasons: the coupon is not written correctly, the offer has expired, the code is for a single use or Diagonal Eyewear S.L. has detected some kind of fraudulent use of the code.
What happens if I have to returns an order which have a discount coupon?
Before placing an order using a discount code, remember that if you finally decide to return the order, this discount code expires, that is to say, you will not be able to use it again in the following purchases, except in the case that the promotion is still valid.
Please also note that the discount applied will not be refunded in any case.

WAIVER
